ClearDay App Terms of Use

1. Introduction

These Terms of Use govern your use of the ClearDay mobile application and its related features and services.

ClearDay is provided by Live Rehab Ltd ("Live Rehab", "we", "us", or "our").

By downloading, accessing, purchasing a subscription through, or using ClearDay, you agree to these Terms. If you do not agree to these Terms, do not use the app.

2. ClearDay is not medical care

ClearDay is a private recovery-tracking, journaling, and self-reflection tool.

ClearDay does not provide medical advice, diagnosis, treatment, counselling, detox supervision, or emergency services. It is not a substitute for support from a qualified medical, mental-health, or addiction professional.

Do not rely on ClearDay when making medical or treatment decisions.

If you believe you may be experiencing a medical emergency, severe withdrawal, or an immediate risk of harm to yourself or someone else, contact your local emergency services or an appropriate crisis service immediately.

No feature of ClearDay guarantees sobriety, recovery, improved health, financial savings, or any other particular result.

3. Eligibility

ClearDay is intended for adults aged 18 or over.

By using ClearDay, you confirm that you are legally capable of entering into an agreement in the country or region where you live.

4. Permission to use ClearDay

Subject to these Terms, Live Rehab grants you a limited, personal, revocable, non-exclusive, and non-transferable right to use ClearDay for your own personal and lawful purposes.

You must not: • copy, sell, rent, sublicense, or commercially exploit the app • interfere with, damage, or attempt to gain unauthorised access to the app or its systems • reverse engineer or modify the app except where applicable law expressly permits it • use ClearDay for unlawful, fraudulent, or harmful purposes • falsely suggest that you or another product is affiliated with or endorsed by Live Rehab

Live Rehab and its licensors retain all rights, title, and interest in ClearDay, including its software, design, branding, written content, audio, and other materials.

5. Your recovery information

You remain responsible for the recovery journeys, check-ins, reflections, notes, and other information you create in ClearDay.

Core recovery information is designed to be stored locally on your device. You are responsible for maintaining access to your device and for any device-level backups you choose to use.

Deleting ClearDay, clearing its data, losing or replacing your device, or experiencing a device failure may result in locally stored information being permanently lost.

6. ClearDay Pro

ClearDay may offer an optional paid subscription called ClearDay Pro.

ClearDay Pro may provide access to additional features such as deeper check-ins, guided prompts, trend insights, meditations, and export options. The features included may develop or change over time.

The subscription options currently offered may include: • a monthly auto-renewable subscription • a yearly auto-renewable subscription • a seven-day trial on the monthly subscription where the relevant app-store account is eligible

The subscription period, price, included features, and availability of any introductory offer are displayed in the app before you confirm a purchase.

Prices may vary by country or region and may include applicable taxes.

7. Payment and automatic renewal

ClearDay Pro subscriptions are processed by the store through which you obtained the app. Live Rehab does not directly collect or store your app-store payment details.

When purchasing through Apple's App Store: • payment is charged to your Apple Account when you confirm the purchase • the subscription automatically renews for the same subscription period unless auto-renewal is turned off at least 24 hours before the end of the current period • your Apple Account may be charged for renewal within 24 hours before the end of the current period • the renewal charge will be shown by Apple before you confirm the original purchase

When purchasing through Google Play: • payment is charged to your Google Play account • the subscription renews automatically unless cancelled before the end of the current billing period • billing and renewal are handled according to the terms shown by Google Play

Deleting ClearDay does not cancel an active subscription.

8. Free trials and introductory offers

A seven-day trial may be available with the monthly ClearDay Pro subscription.

Trial eligibility is determined by Apple or Google using the relevant app-store account. Live Rehab cannot change an app store's eligibility decision.

If a trial is available, the subscription will automatically convert to the paid monthly plan at the price displayed before purchase unless it is cancelled before the trial ends.

Any unused part of a trial or introductory offer may be forfeited when a subscription is purchased, where permitted by the relevant app store and applicable law.

9. Managing or cancelling a subscription

You can manage or cancel ClearDay Pro through the store where you purchased it.

For Apple subscriptions: Settings → your name → Subscriptions → ClearDay

For Google Play subscriptions: Google Play → profile → Payments and subscriptions → Subscriptions → ClearDay

Cancellation normally takes effect at the end of the billing period you have already paid for. You should retain access to ClearDay Pro until that period ends unless a refund or other store action changes your entitlement.

Stopping use of the app or deleting it from your device does not cancel your subscription.

10. Restoring purchases

ClearDay may allow you to restore a previous purchase using the Apple Account or Google Play account that originally purchased the subscription.

Subscription restoration depends on the relevant app store and the status of the purchase. Live Rehab cannot restore a purchase associated with a different store account.

11. Refunds and billing disputes

Purchases made through Apple's App Store or Google Play are subject to the refund and billing policies of the relevant store.

Live Rehab does not directly process app-store payments and cannot issue refunds for purchases processed by Apple or Google.

Refund requests should be submitted through the store where the purchase was made.

Nothing in this section limits any refund or consumer rights that cannot legally be excluded.

12. Subscription and feature changes

We may add, remove, improve, or change ClearDay and ClearDay Pro features over time.

If a subscription price changes, Apple or Google will provide any notice or request any consent required under applicable law and the store's policies.

We may stop offering a subscription plan to new customers. Existing subscriptions will be handled according to the relevant app-store rules and applicable law.

13. App-store terms

Your use of ClearDay is also subject to the terms and usage rules of the store through which you downloaded it.

For downloads from Apple's App Store, these Terms should be read together with Apple's Standard End User Licence Agreement.

The agreement governing ClearDay is between you and Live Rehab, not Apple. Live Rehab, rather than Apple, is responsible for ClearDay and its content, maintenance, support, and any claims relating to the app, except where Apple has responsibilities under its own applicable terms or the law.

Apple does not endorse ClearDay and is not responsible for any recovery, medical, or behavioural claims associated with the app.

For downloads from Google Play, the Google Play Terms of Service and other applicable Google Play policies also apply.

You must comply with all applicable third-party terms when using ClearDay.

14. Availability and updates

We work to keep ClearDay available and functioning, but we do not guarantee that it will always be available, uninterrupted, secure, or free from errors.

Features may be changed, suspended, or discontinued. Updates may be required for continued use, compatibility, security, or legal compliance.

Some functionality may depend on your device, operating system, internet connection, app-store services, or third-party services outside our control.

15. Intellectual property

Unless otherwise stated, ClearDay and all material provided through it are owned by or licensed to Live Rehab.

These Terms do not transfer ownership of the app, its content, its branding, or any related intellectual property to you.

You retain ownership of the personal entries and reflections you create.

16. Disclaimers

To the fullest extent permitted by law, ClearDay is provided "as is" and "as available".

We do not warrant that: • ClearDay will always be available or error-free • information or calculations shown in the app will always be complete or accurate • using ClearDay will produce a particular recovery or health outcome • estimated savings will match your actual financial results • locally stored information can always be recovered

You remain responsible for decisions you make based on information recorded or displayed in the app.

17. Limitation of liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or your mandatory consumer rights.

Subject to those protections and to the fullest extent permitted by law, Live Rehab is not liable for: • indirect or consequential losses • loss of locally stored information • loss caused by deleting the app, device failure, or failure to maintain a backup • loss arising from reliance on ClearDay as medical care or professional treatment • loss caused by Apple, Google, your device provider, or another third party • circumstances outside our reasonable control

18. Ending your use of ClearDay

You may stop using ClearDay at any time.

We may suspend or terminate access where reasonably necessary to protect ClearDay, comply with the law, or respond to a serious or repeated breach of these Terms.

Ending your use of ClearDay does not automatically cancel an active subscription. Subscriptions must be cancelled through the relevant app store.

Sections of these Terms that are intended to continue after termination will remain in effect, including provisions concerning intellectual property, disclaimers, and liability.

19. Changes to these Terms

We may update these Terms to reflect changes to ClearDay, subscription features, app-store requirements, or applicable law.

The updated date at the top of this page will change when these Terms are revised. Where required by law, we will provide additional notice.

Your continued use of ClearDay after updated Terms take effect means that you accept the revised Terms.

20. Governing law and consumer rights

These Terms are governed by the laws of England and Wales.

If the mandatory consumer laws of your country or region provide additional protections or require another law or forum to apply, those mandatory rights remain unaffected.

Nothing in these Terms removes any legal rights that cannot be waived.
